AGU notifies Google to remove profiles that promote illegal betting

The Federal Attorney General’s Office (AGU) extrajudicially notified Google, owner of YouTube, to remove profiles that promote and facilitate the creation of illegal casino platforms and encourage prohibited games, such as “bicho”.

According to the AGU, the measure aims to combat national legislation and ensure compliance with decisions of the Federal Supreme Court (STF).

The National Prosecutor’s Office for the Defense of Democracy (PNDD), which promoted the notification, sent a document to the company Google showing profiles with tutorials for illegal betting platforms, that is, those that are not authorized to operate in the country. An example of induction comes with calls on “how to create a casino platform” or marketing strategies for “jogo do bicho online”.

The AGU states that, although the profiles call themselves digital marketing companies, “they freely propagate unregulated gambling and encourage practices that constitute a criminal offense, in accordance with Decree-Law No. 3,688/1941”.

The AGU also said that this type of content ignores legal authorization and certification duties, provided for in Law 14,790/2023, which determines that fixed odds bets can only be explored with prior authorization from the Ministry of Finance.

According to the AGU, these profiles offer the user the option of exploring illicit activities without any reservations.

Furthermore, the notification highlights that YouTube’s own Terms of Use prohibit facilitating access to regulated services, such as non-certified gambling sites.

“The AGU warns that the systematic circulation of these materials represents a threat to the integrity of information and the protection of consumers, and may be linked to crimes such as tax evasion and money laundering. Failure to remove the content may generate joint civil liability for the platform,” said the AGU.
