ANDlon Musk lost the lawsuit filed against OpenAI and its founder, Sam Altman. The final verdict was announced this Monday, ending another chapter in the dispute between the two technology billionaires, who were once close allies.
After more than two hours of deliberation, a jury rejected Musk’s charges against Altman and OpenAI president Greg Brockman.
The businessman accused OpenAI of having manipulated him into donating US$38 million to the organization and subsequently transforming the company into a for-profit structure without his consent. According to Musk, OpenAI would have accepted billions in investments from Microsoft and other investors while moving away from the original non-profit proposal.
The jury, made up of nine people, concluded that the action presented by Musk was not filed within the deadline provided by law.
In a unanimous decision, the federal court in Oakland, California, stated that there were insufficient grounds to support the accusations made by the owner of Tesla and SpaceX, according to information from Reuters.
After the result, Musk’s defense stated that he could still appeal the decision. Federal Judge Yvonne Gonzalez Rogers, however, indicated that a reversal could be difficult.
“There is a substantial amount of evidence supporting the jury’s decision, which is why I was prepared to dismiss the case immediately,” said the judge.
The trial ended after 11 days of testimony, a period in which the credibility of both Musk and Altman was constantly questioned.
Both defenses accused the opposing side of being more interested in money than in benefiting the public with the development of artificial intelligence.
“Sam Altman’s credibility is at stake. If you don’t believe in him, he can’t win,” said Elon Musk’s lawyer during the trial.
OpenAI classified the process as a baseless attempt to harm a competitor through the judicial system.
During the trial, OpenAI’s lawyers presented email exchanges between Musk’s advisors discussing the possibility of the businessman receiving equity in the company if it officially ceased to be a non-profit organization.
The process began on April 28, after Musk filed the lawsuit in the summer of 2024. The businessman alleged that OpenAI deceived him by abandoning the company’s original proposal and seeking a profit-oriented structure.
The rivalry between Musk and Sam Altman began more than a decade ago.
In 2012, Altman was introduced to Musk and shared the initial idea for OpenAI with him. Three years later, in 2015, Musk joined the company’s group of 11 co-founders, alongside Altman, Brockman, Ilya Sutskever and other names linked to the technology sector.
OpenAI was born as a non-profit organization with the aim of developing artificial intelligence capable of surpassing human capabilities and preventing giants like Google from completely dominating the area.
With the increase in the need for financing, the transformation of the company into a for-profit structure began to be discussed internally.
Despite Musk’s current criticism, OpenAI claims that he supported this change before leaving the company in 2019.
According to reports from people linked to the company at the time, Musk wanted to take control of OpenAI and even considered a merger with Tesla. The proposal did not advance and, after disagreements with the other founders, he left the company.
In the following years, OpenAI received billion-dollar investments from Microsoft and gained global recognition with the launch of ChatGPT in 2022.
Musk, in turn, created the company xAI, becoming a direct competitor to OpenAI.
Even after leaving the company, the businessman continued to publicly attack Sam Altman. On different occasions, Musk called the executive a “scammer” and also used the nickname “Scam Altman”, a pun on the English word “scam”, which means fraud or scam.
