The Minister of Finance, Dario Durigan, defended this Tuesday (12) a regulatory model for artificial intelligence (AI) based on risk levels of technological applications. In an interview with the program Na Mesa com Datena, on TV Brasil, the minister stated that the government wants to create flexible rules to keep up with the rapid evolution of AI without requiring new laws with each technological advance.

According to Durigan, artificial intelligence represents a new stage in global digital transformation. “What we want is to make the rules of good civility also valid in the digital environment”, said the minister to journalist José Luiz Datena.

The debate on the regulatory framework for artificial intelligence is being discussed in the National Congress and involves coordination between the government and parliamentarians. The minister informed that the project’s rapporteur in the Chamber, deputy Agnaldo Ribeiro (PP-PB), is in favor of the proposed model.

Risk matrix

The main axis of the government’s proposal, explained Durigan, is the creation of a risk matrix to classify different types of artificial intelligence. “We have to put together a risk matrix (for AI),” Durigan said.

The idea is to replace rigid legislation models with a system that assesses the potential impact and danger of each technological application.

According to the minister, AI technologies considered more sensitive will have greater requirements for transparency, control and compliance. Less impact tools would have simplified rules.

Sensitive AI

Among the applications classified as high risk would be systems linked to human genetics, identity recognition and topics considered sensitive to individual rights.

According to Durigan, these tools will require rigorous oversight and accountability mechanisms.

The government also intends to discuss ethical limits for the use of these technologies, especially in areas related to privacy and fundamental rights.

Less regulation

Applications aimed at games, entertainment and recreational functions must be classified in low-risk categories.

In these cases, the proposal is to avoid excessive bureaucracy so as not to slow down innovation and technological development.

According to the minister, the objective is to create a regulatory environment that can balance protecting society and encouraging innovation.

Digital education

Durigan also stated that digital literacy will be essential to protect the population in the virtual environment.

According to the minister, the government considers it necessary to combine technological education with stricter regulatory mechanisms to prevent abuse and protect vulnerable groups.

“In real life, you will have a series of guidelines from your family, from school, but that doesn’t guarantee that you won’t fall for a scam, a crime. In digital, it’s the same thing, you need to be educated, but the rules for the digital environment need to evolve a lot. That’s why we’re discussing in Brazil the implementation today of the Digital ECA (Statute of Children and Adolescents), “he declared.

Flexible legislation

Durigan said the speed of technological change requires a more open and adaptable regulatory model.

“Sociality today migrates to the digital sphere and the rules need to evolve”, he declared. Before going to the Ministry of Finance as executive secretary to Fernando Haddad, in 2023, Durigan worked in areas of institutional compliance at WhatsApp and Meta.

According to the minister, Congress would not be able to approve new legislation for each relevant technological transformation. The proposal defended by the government is to create general principles and flexible mechanisms that can follow the evolution of artificial intelligence in real time.
