The Attorney General’s Office (AGU) will request this Monday, 15th, Brazil’s intervention in the legal action filed by the companies Rumble Inc and Trump Media & Technology Group Corp, owner of the social network Truth Social, against Minister Alexandre de Moraes, of the Federal Supreme Court (STF), in a court in Florida (USA).
The judge is the target of American companies, including the one owned by Donald Trump, because of his orders to remove content on these social networks. The platforms accuse Moraes of violating American sovereignty. The same argument is replicated by the AGU when requesting Brazilian intervention in the ongoing case in the United States.
“Brazil has not consented and will not consent to the assessment of decisions of our Supreme Court by judges from another country. Brazilian judicial decisions must be complied with or questioned before our own courts, in accordance with the procedural law in force in Brazil”, wrote the AGU in a press release.
The AGU states that the objective of the intervention is for the process to be extinguished. “This is, ultimately, an attempt to offend national sovereignty and the independence of the Brazilian Judiciary,” he added.
The ministry will request the Florida court to authorize the Brazilian State in the case files. The action filed by the companies targets only Moraes, but Brazil will now intervene in favor of the minister in the action, as it understands that a Brazilian authority cannot be subjected to the jurisdiction of foreign courts.
“The measure aims to promote the defense of the interests of the Brazilian State and maintains, above all, that judicial decisions handed down by the Supreme Court of our country cannot be questioned before the courts of foreign States”, explained the AGU.
“The submission of sovereign jurisdictional acts for consideration by courts in other countries implies a serious offense against immunity from jurisdiction, a principle enshrined in International Law and also recognized by the laws of the United States”, the note continued.
On May 22, the United States Court authorized Rumble and Trump Media to quote Moraes via email. The American Court awaits Moraes’ statement on the action or possible request for more time. If there is no response, companies may request registration by default, which could pave the way for new measures in the process.
Summons is the formal act by which a person is informed that they are responding to an action and now has a deadline to express themselves in the process. During the same period, companies must present to the court proof that the communication was made.
The AGU’s action in favor of Moraes comes months after the magistrate acted behind the scenes to reject the nomination of Jorge Messias, head of the department, to the position of minister of the STF.
